
Law school memories flash through my mind whenever I encounter a statutory rape case. My group mates persuaded me to play the role of a victim of a statutory rape in our Trial Practice course because of my youthful look. Way back in college, nene (child) is my usual role in most theater production. Sometimes, I try to figure out whether it is a compliment or simply a sarcasm. It reminds me to ponder Psalm 139:
13 For you created my inmost being;
you knit me together in my mother's womb.

I know that full well.

My heart is inundated with lavish gratitude to God at this moment for sparing me from experiencing such kind of heinous crime in real life and for protecting me from committing sexual immorality throughout my entire life.
So what is a Statutory Rape?
A statutory rape is committed by a man who shall have carnal knowledge (sexual intercourse) with a woman who is younger than that statutory age of consent. In the Philippines, UNDER twelve (12) years old is considered to be below the age required to legally consent to the behavior as provided for by Article 266-A of the Revised Penal Code (as amended by R.A. No. 8353) (so now you understand me as to whether it is a compliment or a sarcasm ^_^)
When the offended party is UNDER twelve (12) years of age or demented, Rape is committed even though NONE of the following circumstances are present:
1. through force, threat or intimidation;
2. when the offended party is deprived of reason or is otherwise unconscious;
3. by means of fraudulent machination or grave abuse of authority.
Accordingly, Rape is committed even if the girl UNDER twelve (12) years old is a prostitute. Further, it is committed although she consented to the sexual act. The law does not consider that kind of consent voluntary, as the offended party under 12 years old cannot have a will of her own.
i would like to ask suggestion coming from an expert. my niece is one of the victim of this crime. how do we take our first step to commit justice?

ReplyDeletei am a 21-yr old girl having a somewhat mutual understanding and an open relationship with a 17-yr old guy... we like each other but the guardian of the boy said that they will file a case of statutory rape against me if i don't distance myself from the guy having zero communications at all... we love each other though... can they do that to me? how can i defend myself and what are my rights in this situation?

hi! I live in the Philippines and I have a friend who wants to file a complaint against a guy who broke up w/ him. She is 16 and he is 24. Can she sue him for statutory rape? We were told that the legal age here in the Philippines to have sex is 18 for girls. Please help us clarify. Thanks

so if someone can prove that she gave consent when they had sex she can't sue him? even if the guy is 8 years older than him?

ReplyDeletehi, a complaint was filed against me for rape. Iam 33 y/o with a live in partner now. Recently, i had a secret relationship with the daughter of my previous live in partner last 2000. She came to our place, this june 2010, claiming that she has no place to stay. i got her pregnant. My current live in partner found out about us and so i broke up with her( the 17y/o). Now i received a subpoena with a schedule of its 1st hearing on the 2nd week of nov. a day after i received it a warrant of arrest was served. I was not home. we really had a relationship and everytime we had sex, it was with her consent. a lot will attest to that.I fear for my life ma'am. What are my chances? thank you for your reply.we do not have money to get a lawyer to defend me. please, help and enlighten me.. God bless you!

my gf and i ran away. am 20, she's 17. Both 1 year till we become adults. anyways, we do have sex. although i think i got her pregnant. i'm not prepared to be a dad. more so, am not prepared to go to jail. i've read everywhere that rape blah blah is by force and if she's 12 and below but when we were at the percint, they said i could be charged with statutory rape and "sex between minors is rape". wtf? am very very confused....

I have a girlfriend who was only 17 when we had sex and I am 31. But because of her guilt she suffered a brief psychotic disorder and confessed everything to her parents and ministers in the church. she claimed that i raped her but after a few months she was well. because we were adventurous then, we have a video with her consent while having sex that can prove that i never use force or anything at that time. and she retracted her statement to her psychiatrist that i raped her. can the parents file a case against me and what would it be if ever they might think of extortion. i was with her and her mom to when we talk to her psychiatrist. can they charge me of rape? they know nothing about the video since i previously deleted it when my GF asked me to. and i just used a program to retrive it again to my computers' hard drive. my relationship with her mom is now good but with her dad and brothers i think my life is in danger as her mother told me.
