Gusto ko na mag-resign, what shall I do?

        Resignation is a voluntary act of employee which is beyond the control of the employer (People’s Security Inc. vs. NLRC, 226 SCRA 146).   It is a right guaranteed by the Philippine Bill of Rights.

        Section 18. (2) "No involuntary servitude in any form shall exist except as a punishment for a crime whereof the party shall have been duly convicted."
       
        If the resignation is without just cause, the Labor Code mandates that a written notice must be served on the employer at least one (1) month in advance (Art.285).  Otherwise, the employer may hold the employee liable for damages.

    
        The notice requirement may be dispensed with if the employment is terminated for any of the following causes:

1. Serious Insult;
e.g. the transfer of an employee to a lower position

2. Inhuman and unbearable treatment;

3. Commission of a crime or offense by the employer or its representative; and
e.g. slapping the employee

4. Analogous causes
e.g. disapproval of application for an indefinite leave of absence due to illness

        The foregoing causes often constitute Forced Resignation/Constructive Dismissal.   An aggrieved employee therefore, may file a complaint for illegal dismissal before the National Labor Relations Commission.

          Forced Resignation/Constructive dismissal exists when an act of clear discrimination, insensibility or disdain, on the part of an employer has become so unbearable as to leave an employee with no choice but to forego continued employmentSoliman Security Services, Inc. The Court of Appeals, G.R. No. 143215, July 11, 2002).

        Ordinarily, when there is constructive dismissal, which is a form of illegal dismissal, the employer is liable for the full amount of backwages, if reinstatement is no longer possible, and separation pay (Siemens Philippines, Inc. vs. Enrico A. Domingo, G.R. No. 150488, July 28, 2008).

Good morning po, may gusto po kasi akong malaman, Pano po kung pumayag ang employer na 15 days served at pinirmahan na nila ang resigantion letter then nag pag bago sila ng isip few days ago, kasi daw po hindi pa sila nakakahanap ng papalit then baka daw hindi pa maturn over ng maaus ang work. Then pag hindi daw po na ka pag serve ng 1 month ihohold daw nila ang backpay at remaining salary. Wala na po ba kaming magagawa? o tama lang ang employer?. Thank you in advance. God bless.

  2. kung pinirmahan na nila that means tinanggap na nila ang resignation at pumapayag nna sila na effective after 15 days. BAWAL na yang condition nila sayo, yan na ang Involuntary Servitude na tinatawag.

  3. Gusto ko lang po malaman kun ano ang ipapataw ng employer sa isang employee na biglaang nag-resigned without justcause?

  4. WALA. karapatan ng bawat empleyado ang magresign with or without just cause. Kapag ang resignation ay without just cause or walang sapat na dahilan, ayon sa batas, ang empleyado obligadong magbigay sa employer ng written notice 1 month bago mag resign kung hindi pwedeng kasuhan ng employer ang empleyado for damages.

  5. Ano po bang mga damages ang puedeng ipatataw sa isang empleyado na biglang nag-resign without cause na hindi nagbigay ng 1 month written notice sa kanyang employer?

  7. ano po ba ang hnhold ng employer yung 15 and 30 salary or yung last pay lang ng 30 in 1 month notice ?

    question lang po,nagresign po ako sa company kung san ako ngtratrabaho dahil indefinite or hindi malinaw kung magsasara na ito o hindi. ngretrench po sila ng mga emplyeyado pero naretain po ako. since hindi ko na kaya ang sobrang dami ng trabaho eh nagresign na din po ako kasi kmi po ang sumalo sa trabaho ng mga natanggal. binawasan din po ang sahod namin.
    ang sabi po ng hr nmin wala daw po akong makukuha na separation pay dahil resigned po ako. tama lang po ba na wala akong makuha na separation pay? kc kaya nman ako aalis sa kompanya dahil hindi na sapat ang pinapasahod samin dahil nga po binawasan kami ng sahod.
